Women’s quota reservation 3 day debate kicks off today, govt bets on quota, oppn on delimitation

Parliament convenes Thursday for a special three day sitting that could reshape India’s legislative landscape in ways both historic and deeply contested. At the centre of it is the Nari Shakti Vandan Adhiniyam, the Women’s Reservation Act of 2023 , which promised one third of all Lok Sabha and state assembly seats to women, but tied that promise to a census and delimitation exercise that could have delayed its effect until 2034 at the earliest.

The government has now circulated the Constitution (131st Amendment) Bill, 2026, which proposes raising Lok Sabha seats from 543 to as many as 850 , with 815 members elected from state constituencies and up to 35 representing Union Territories. The key change is that by amending Article 82, the Bill removes the requirement that delimitation must follow the first Census conducted post 2026, allowing the process to be carried out using the already available 2011 Census data. This would enable women’s reservation to be implemented before the 2029 general elections , with 273 seats reserved for women in the expanded House.

Both the BJP and the Congress have issued three line whips to their MPs, mandating full attendance across all three days. Prime Minister Narendra Modi has personally written to floor leaders of both Houses, calling it a defining moment and urging consensus, saying India’s Parliament is “on the verge of making new history.” Finance Minister Nirmala Sitharaman cancelled her US trip and skipped the IMF World Bank meeting to focus on the special session and the proposed delimitation commission.

Support has come from across party lines. Former President Pratibha Patil , former Lok Sabha Speaker Meira Kumar , and BSP chief Mayawati have welcomed the move. However, Mayawati also flagged a key concern shared by many: the absence of a quota within the quota for women from SC, ST and OBC communities.

The opposition has drawn a sharp line. INDIA bloc leaders, including Congress president Mallikarjun Kharge , met Wednesday and decided to oppose the delimitation bill while making clear they support women’s reservation in principle. Kharge called the move politically motivated , accusing the government of using the reservation agenda to advance a controversial delimitation framework. Congress leader Jairam Ramesh went further, alleging the delimitation commission is effectively being used as a political instrument.

The structural concern was sharply articulated by Congress leader P. Chidambaram , who warned that southern states could see their representation shrink significantly if population based delimitation proceeds. At present, Kerala has 20 Lok Sabha seats compared to Uttar Pradesh’s 80, but that gap could widen further after expansion, raising fears of regional imbalance in representation .

Another major concern is that the Bill gives Parliament the power to decide by simple majority which Census will be used for delimitation, shifting a constitutional safeguard into ordinary legislation. Under the proposal, the Delimitation Commission’s decisions would be final and not subject to judicial review, raising questions about institutional checks and balances .

By tying women’s reservation and delimitation together, the government has created a high stakes political moment. The opposition now faces a difficult choice between supporting a historic gender reform or resisting a framework they see as reshaping electoral boundaries without consensus.

Civil society voices, including advocate Prashant Bhushan , argue the simplest path would be to delink women’s reservation from both census and delimitation, allowing immediate implementation without expanding Parliament or triggering boundary disputes.

What Parliament decides over the next three days will determine not only whether India finally delivers on a three decade old promise to women, but also the terms on which that promise is fulfilled .
