
Trump Administration Moves To Dismiss Pollution Case Against Musk’s xAI Data Centre
The Trump administration has moved to intervene in a federal lawsuit and seek dismissal of a case against Elon Musk’s xAI, escalating a legal battle over alleged environmental violations tied to a major artificial intelligence data centre in Mississippi.
The lawsuit, filed by the NAACP and environmental groups, accuses xAI and its subsidiary MZX Tech of operating up to 57 natural gas turbines without required permits to power its Colossus data centre complex near Southaven, Mississippi. The facility, valued at around USD 20 billion, lies close to homes, schools and churches in North Mississippi and the Memphis region.
The plaintiffs allege violations of the Clean Air Act , arguing that the turbines emit harmful pollutants including nitrogen oxides, particulate matter and formaldehyde, increasing health risks in already high-pollution communities.
In its filing, the Justice Department asked the court to dismiss the case, arguing that Mississippi regulators had already determined no federal permit was required for the turbines. The DOJ further said the AI facility supports “national, economic and energy security” , including applications linked to Department of War operations and advanced AI systems such as Grok.
Environmental groups, including Earthjustice and the NAACP, strongly oppose the move, saying it attempts to shield a powerful tech company from accountability and undermines public health protections. They have also sought a preliminary injunction to halt turbine operations while the case proceeds.
Recent reporting shows the number of turbines has increased from about 27 to 57 as demand for AI computing power has surged, intensifying concerns about emissions in the region.
xAI maintains that it is compliant with regulations and is working with state authorities on permitting and long-term power solutions.
The case remains active, with no ruling yet on the DOJ’s dismissal request.
