Telangana HC Questions Speaker’s Decision in MLA Disqualification Case

The Telangana High Court has issued notices to Assembly Speaker Gaddam Prasad Kumar and Khairatabad MLA Danam Nagender in the ongoing defection case , bringing the politically sensitive dispute back under judicial scrutiny. Acting on a petition filed by BJP leader Aleti Maheshwar Reddy , the court has sought counter affidavits from both respondents and posted the matter for hearing on April 16 , signalling a renewed examination of the Speaker’s decision to reject the disqualification pleas .

At the heart of the dispute lies a politically sensitive question whether an elected representative can continue in office after allegedly shifting loyalties without formally resigning. Nagender, who secured victory on a BRS ticket , is accused by opposition parties of aligning with the ruling Congress , even contesting the Lok Sabha elections under its banner. The opposition argues that such actions violate the anti-defection law under the Tenth Schedule , which is meant to safeguard the mandate of voters.

Despite these allegations, the Speaker, in his March 11 order , dismissed the petitions, stating there was insufficient material to conclusively prove defection. The decision also covered another leader, Kadiyam Srihari , who faced similar accusations. The move drew criticism from opposition parties, who alleged that the ruling undermined constitutional principles .

Before the High Court, the petitioner’s counsel argued that the Speaker adopted a narrow view by limiting his assessment to actions within the legislature. The plea stressed that political conduct outside the Assembly , such as contesting elections under a different party, should also be treated as valid grounds for disqualification. The argument relies on past Supreme Court precedents from states like Karnataka and Bihar, where broader interpretations of defection were considered.

The case is now being seen as a potential test of how effectively the anti-defection framework is enforced. With several reports suggesting that multiple BRS legislators have shifted allegiance to the Congress, the outcome could influence future rulings on similar disputes.
