Telangana HC Halts Action on Kaleshwaram Probe, Relief for KCR and Harish Rao

The Telangana High Court has delivered a significant ruling in the politically sensitive Kaleshwaram Lift Irrigation Project case, granting major relief to former Chief Minister K. Chandrashekar Rao and former minister T. Harish Rao by restraining the state from taking action based on the Justice P.C. Ghosh Commission report. The bench, led by Chief Justice Alok Aradhe , clarified that while the commission itself was legally constituted, its findings could not be enforced due to serious procedural lapses. At the core of the judgment is the violation of natural justice , as the court found that the accused were not given a fair opportunity to present their case before adverse conclusions were drawn, thereby undermining safeguards under the Commissions of Inquiry Act, 1952 .

The controversy stems from allegations of irregularities in the execution of the Kaleshwaram Project , particularly concerning the construction and reported failures of key barrages such as Medigadda , Annaram , and Sundilla . The commission had attributed responsibility to senior political leaders and officials, prompting the current government to consider further investigation, including a possible CBI probe . However, the High Court’s decision has effectively halted any immediate punitive action , rendering the report’s adverse observations legally inoperative for now. This not only delays accountability proceedings but also raises questions about how large-scale infrastructure investigations should be conducted within constitutional limits.

Politically, the ruling has intensified the confrontation between the ruling Congress and the opposition BRS , with the latter calling the verdict a vindication against alleged political vendetta . Leaders like K.T. Rama Rao have argued that the report lacked credibility and accused the government of misusing institutions for political purposes. At the same time, the judgment places the onus back on the state to pursue accountability through legally sound procedures, possibly by initiating fresh inquiries or seeking judicial review.
