SCB mortgage rule faces Telangana HC scrutiny

The Telangana High Court has admitted a petition filed by BRS leader Manne Krishank, challenging the Secunderabad Cantonment Board’s (SCB) new mortgage rule. The petitioner contends that the application of mortgage conditions to small plots, such as those measuring 111 square meters, imposes undue financial burdens on middle-class families. In response, the court has issued notices to the SCB, directing it to file a counter within one week.

The petitioner’s counsel, Senior Advocate MAK Mukheed, highlighted that while the Greater Hyderabad Municipal Corporation (GHMC) mandates a 10% mortgage only for plots exceeding 200 square meters, the SCB has extended this requirement to smaller plots. This extension, according to the petition, makes it challenging for ordinary citizens within the cantonment area to construct homes.

Additionally, the petition points out that unlike the GHMC’s TS-bPASS system, which streamlines building permissions, the SCB requires approval through board resolutions, further complicating the process for residents.

The High Court’s intervention underscores the ongoing scrutiny of local governance practices and their impact on residents. The outcome of this case may influence future policies concerning property regulations within cantonment areas.

As the court has directed the SCB to respond within a week, the case is expected to proceed expeditiously, with potential implications for property owners and prospective buyers in the region.
