SC Refuses To Frame National Guidelines On Time-Bound Case Disposal

The Supreme Court of India on Thursday refused to entertain a plea seeking framing of guidelines for time-bound disposal of cases , declining to issue nationwide directions for regulating judicial timelines and case management practices.

A bench comprising Justice Vikram Nath and Justice V Mohana dismissed the petition filed by a lawyer , who had sought uniform, structured and enforceable guidelines to regulate adjournments across all courts in the country and ensure time-bound disposal of cases .

The petitioner had also sought the formulation and implementation of a national case flow management policy applicable to all courts, including stage-wise timelines for hearings , strict regulation of adjournments, provisions for day-to-day hearings in appropriate matters , and mechanisms for priority disposal of long-pending cases to reduce judicial delays.

During the hearing, the bench indicated that such issues fall within the domain of institutional and administrative mechanisms rather than judicial directions under Article 32 of the Constitution. The court advised the petitioner to approach the Bar Council of India, State Bar Councils, High Court Bar Associations, and other legal bodies , which are better placed to consider reforms related to court procedures and adjournment practices .

In a lighter observation, the bench also noted that the judiciary should not be drawn into framing sweeping procedural frameworks that may impact court administration nationwide , reiterating that such matters require consultation within the legal ecosystem.

The petition was dismissed at the threshold , with the Supreme Court reiterating its reluctance to lay down uniform national guidelines governing case disposal timelines or adjournment regulation across all courts in India.
