SC issues notice to Andhra Govt. over pension rule

In a significant development with potential implications for thousands of government retirees, the Supreme Court has issued a notice to the Andhra Pradesh government regarding its rule on pension commutation recovery. The court's action comes in response to a petition filed by a retired Tahsildar, B. Apparao, which directly challenges a judgment delivered by the Andhra Pradesh High Court earlier this year.

The legal battle centers on Section 18 of the Andhra Pradesh Civil Pensions (Commutation Rules) of 1944, a provision that mandates the recovery of the commuted portion of a retiree's pension over a period of 15 years. Pension commutation allows a retired employee to receive a lump-sum payment in exchange for a portion of their monthly pension. The core of Apparao's argument is that this recovery period is both excessive and unconstitutional.

Apparao’s petition highlights his personal case to illustrate the injustice of the rule. He informed the Supreme Court that the full commuted amount of ₹7.55 lakh, along with an annual interest of 8%, was fully recovered from his pension in just 11 years and 3 months. Despite this, the standing rule requires the recovery to continue for the full 15-year term, which he argues would result in a financial loss to him for the remaining 3 years and 7 months. Apparao's plea is for the court to not only declare this section of the rule unconstitutional but also to repeal it entirely.

A bench comprising Justice J.K. Maheshwari and Justice Vijay Bishnoi considered the compelling arguments presented by the petitioner and took the crucial step of issuing a formal notice to the AP government. This move compels the state to present its defense of the rule in court. The Supreme Court's decision to accept the petition and issue a notice indicates that the court views the matter as worthy of a detailed review. The next hearing will see the court meticulously examine the constitutional validity of the rule and its implications for retirees across the state.
