Police error delays bail, Allahabad HC orders ₹50,000 compensation from UP Govt

The Allahabad High Court has directed the Uttar Pradesh government to pay ₹50,000 compensation to an accused after incorrect police information led to a 15-day delay in his release on bail, raising concerns over negligence within the criminal justice system.

The order was passed by Justice Arun Kumar Singh Deshwal while hearing the bail plea of Furkan, who was arrested in November 2025 in a car theft case. Although the court granted him bail on March 10, it noted that he could have been released earlier, on February 23, had accurate information been placed on record.

According to the case details, the investigating officer (IO) informed the court that the accused had 12 prior criminal cases. However, it later emerged that Furkan had only five cases against him. The inflated figure was used to oppose his bail plea, resulting in his continued incarceration for an additional 15 days.

The High Court held the investigating officer responsible for submitting incorrect information but clarified that there was no mala fide intent. “There was a mistake because of his negligence that may be due to the workload on him,” the court observed, while directing the state to compensate the accused within one month.

During the hearing, Additional Director General of Police (Technical Services) Naveen Arora admitted the error and informed the court that accurate criminal records could be easily verified through digital platforms such as the Crime and Criminal Tracking Network and Systems (CCTNS) and the Inter-operable Criminal Justice System (ICJS).

The court also flagged systemic shortcomings, noting that access to such systems was not being effectively utilised due to staff shortages. It directed the Director of Prosecution to ensure adequate staffing so that officials can retrieve case records promptly and prevent similar delays.

The ruling underscores that even negligent errors by law enforcement agencies, particularly those affecting personal liberty, can attract judicial intervention and financial liability for the state.
