Oppn Notices to Remove CEC Rejected by RS Chairman, LS Speaker

A fresh political confrontation has emerged at the centre of India’s democratic framework after opposition parties attempted to initiate removal proceedings against Chief Election Commissioner Gyanesh Kumar , only to see their efforts halted at the preliminary stage. Notices submitted by opposition MPs in both Houses under Article 324(5) were rejected by Lok Sabha Speaker Om Birla and Rajya Sabha Chairman C.P. Radhakrishnan , effectively blocking any further parliamentary action. Despite securing the backing of 193 MPs , well above the required threshold, the proposal failed to move forward as presiding officers ruled that the allegations did not meet the stringent constitutional standard of “proved misbehaviour or incapacity.”

The opposition had raised concerns over alleged bias , electoral irregularities , and issues linked to the Special Intensive Revision (SIR) of voter rolls, arguing that these warranted serious scrutiny. However, authorities maintained that several claims either lacked sufficient evidence or were already under judicial review, making them unsuitable for initiating such a serious constitutional process. The removal mechanism for the CEC, which mirrors that of a Supreme Court judge , is intentionally rigorous to safeguard the independence and autonomy of the Election Commission.

Reacting strongly, Congress leader Jairam Ramesh hinted at deeper political undertones, remarking that his party is aware of what happened to a previous Rajya Sabha Chairman who had accepted a similar petition an apparent reference to former Vice President Jagdeep Dhankhar , who resigned citing health reasons. His statement has intensified the political narrative, with opposition leaders questioning the transparency and fairness of the decision-making process.

The episode marks a rare and significant attempt to remove a sitting CEC, underscoring growing tensions between the opposition and key constitutional institutions. With the notices rejected at the admission stage, the opposition is now left to explore alternatives such as legal intervention or sustained political mobilisation. Meanwhile, the controversy has reignited a broader debate on balancing accountability with institutional independence, a theme likely to remain central as the country moves closer to crucial electoral contests.
