Odisha govt planning law to check abusive language on social media: Minister

The Odisha government is considering bringing in legislation to curb the use of abusive and offensive language on social media, with provisions that could include fines and imprisonment for offenders.

State Law Minister Prithiviraj Harichandan said the government was examining the proposal as online platforms were increasingly turning into “toxic media.” In a post on X, he warned users against posting offensive remarks. “ Those making vile comments on social media should refrain from doing so. Otherwise, the government will take strict action against them in the coming days, ” he said.

Harichandan also expressed concern over the growing use of abusive language online. “ Social media is in the process of becoming toxic. Abusive language is being used and there are no restrictions on it, ” he said, adding that the proposed legislation would target obscene and abusive speech and ensure accountability for those misusing online platforms.

The move follows recommendations submitted by the Odisha State Law Commission , which has proposed a broader “Prevention of Hate Speech and Hate Crime Act.” The draft recommendations suggest prison terms ranging from one to five years and fines for hate-related offences, while repeat offences could attract two to seven years’ imprisonment along with higher penalties.

Officials said the proposed law could treat such offences as cognisable and non-bailable , allowing police to take action without a warrant. Authorities may also be empowered to block or remove harmful online content and take preventive measures if hate-related offences are anticipated.

The proposed framework defines hate speech broadly , covering spoken or written words, visible representations or electronic communications that incite hostility against individuals or groups on grounds such as religion, caste, race, gender, language or place of birth.

Sources said the legislation may also extend beyond digital platforms to regulate abusive language in public spaces .

The proposal has drawn mixed political reactions. Odisha BJP’s social media chief Umakant Patnaik supported the move, saying stricter laws were necessary to curb misuse of social media platforms.

However, BJD youth wing president Chinmay Sahu expressed concern over possible misuse. “ The BJP may use this proposed law for political benefit and target political opponents, ” he said.

Congress student leader Yasir Nawaz also criticised the proposal, alleging that BJP leaders themselves frequently use offensive language against their rivals on social media.
