Landmark Verdict: Heirs to Represent Deceased Doctors in Negligence Cases

In a significant ruling with far-reaching implications, the Supreme Court of India has held that legal heirs of a deceased doctor can be brought on record in a medical negligence case , allowing proceedings to continue even after the doctor’s death.

The verdict came from a bench of Justices J.K. Maheshwari and A.S. Chandurkar in a case dating back over three decades. The dispute involved allegations that a patient lost vision following surgery performed in 1990. During the prolonged litigation, both the doctor and the complainant passed away, raising a key legal question whether the “right to sue” survives the death of the accused.

Interpreting provisions under the Civil Procedure Code and the Consumer Protection laws of 1986 and 2019, the court ruled that the right to pursue such claims does survive , and therefore legal heirs can be implemented to represent the deceased doctor’s estate . However, it clarified that liability will depend on evidence and cannot be presumed solely due to inheritance .

The court described the matter as “exceptional” and limited its observations to interpreting existing law, leaving broader policy considerations to lawmakers. It also suggested a relook at Section 306 of the Indian Succession Act, 1925, by expert bodies such as the Law Commission.

While the judgment is seen as a progressive step ensuring that justice is not derailed by death , it also raises important concerns. Legal heirs, often with no connection to the professional conduct of the deceased, may now be drawn into complex litigation. This underscores the need for a balanced legal framework that protects victims’ rights without unfairly burdening successors.

The ruling is expected to influence a wide range of civil claims, including personal injury and accident cases.
