KCR Strikes: SIT Notice Violates Law, Flags to Jubilee Hills ACP

In the ongoing phone-tapping investigation, BRS chief and former Chief Minister K. Chandrashekhar Rao (KCR) strongly objected to the notice issued by the Special Investigation Team (SIT), requesting his presence for questioning. KCR sent a letter to the Jubilee Hills ACP, claiming the SIT’s actions were unconstitutional and that the officials had ignored Supreme Court directives. He alleged that the notice had impugned his dignity and was issued in violation of legal procedures.

KCR pointed out that the previous two notices issued by the SIT were also legally invalid . He explained that when the first notice was served, he was busy with municipal elections and had requested an alternative date. He further reminded the SIT of Section 160 of the CrPC, which mandates that individuals above 65 years of age should be questioned at their residence, and requested that all future notices be sent to his Erravalli residence .

Despite these communications, KCR expressed outrage that a SIT-signed notice was reportedly pasted on the wall of his Nandini Nagar residence at 9 PM. He condemned the act, questioning whether it was personally carried out by the officials or under their orders, and stated that it reflects disregard for the Constitution, law, and Supreme Court guidelines .

Referring to the Supreme Court’s directions in the Satendra Kumar Antil vs CBI case, KCR emphasized that serving notices via WhatsApp or other electronic means is not lawful . Notices must be delivered personally, as mandated by law under Section 160 of the CrPC. He warned that any violation could be subject to court censure .

KCR clarified that he does not reside within the jurisdiction of any police station covered by the SIT, stressing that notice delivery must consider an individual’s actual residence. Highlighting the discrepancy, he noted that despite an affidavit showing his Siddipet address, the SIT served notices in Hyderabad, exposing double standards in their procedures.

While raising all legal objections, KCR stated that as a former Chief Minister, current opposition leader, and responsible citizen, he is willing to cooperate with the investigation. Accordingly, he confirmed that he would be available at his Nandini Nagar residence at 3 PM today and requested that the SIT record his statement there.
