Kamineni hospital ordered to pay ₹1 cr for medical negligence

In a landmark decision, the Telangana State Consumer Disputes Redressal Commission in Nalgonda has held Kamineni Institute of Medical Sciences, Narketpally responsible for medical negligence that led to the death of a patient after childbirth. The hospital has been directed to pay ₹1 crore in compensation to the victim’s family.

Case background

The victim, Asnala Swati, a 23-year-old pregnant woman, was admitted to Kamineni Institute of Medical Sciences on July 13, 2018, for delivery. She underwent a Caesarean section and delivered a healthy baby boy. However, Swati lost consciousness after the surgery and tragically passed away the next day, on July 14, 2018.

Allegations of negligence

Swati’s family filed a complaint citing two major instances of alleged negligence:

• Repeated administration of anesthesia: During the C-section, Swati regained consciousness. To complete the surgery, doctors administered a second dose of anesthesia. The family contended that this second dose directly contributed to her post-operative complications and eventual death.

• Inadequate post-operative care: The family also accused the hospital of failing to properly monitor Swati after the surgery. Delayed response to excessive bleeding and other complications, they claimed, was a critical factor leading to her death.

Commission’s verdict

After a thorough investigation, the Consumer Disputes Redressal Commission concluded that the hospital and its medical staff failed to provide adequate care. Swati’s death was directly attributed to medical negligence and improper treatment.

Compensation and payment instructions

The commission ordered Kamineni Institute of Medical Sciences to pay ₹1 crore in compensation to the family, along with ₹1 lakh to cover legal expenses.

• ₹90 lakh is to be deposited in a fixed deposit account in the name of Swati’s minor son, Asnala Devansh Shaurya, to be held until he reaches adulthood. The interest earned can be used for his welfare.

• The remaining ₹10 lakh is to be paid to her father, represented legally by Sapidi Satyanarayana under a general power of attorney.

The hospital has been given one month to pay the compensation. In case of delay, interest will accrue at 9% per year until the full amount is paid. Kamineni Hospital has filed an appeal against the commission’s ruling.

Medical perspective on anesthesia risks

Though serious complications from anesthesia are rare, they can be life-threatening, affecting the heart and central nervous system. Overdose or accidental administration may lead to symptoms such as confusion, muscle weakness, irregular heartbeat, respiratory failure, or cardiac arrest. While anesthesia is generally safe when properly administered, careful monitoring is crucial to prevent fatal outcomes.
