Dileep Acquittal Under Challenge as Kerala Seeks Review of Verdict

The Kerala government has decided to file an appeal against the trial court verdict in the 2017 actress abduction and sexual assault case, challenging the acquittal of actor Dileep and seeking a review of the punishment awarded to the convicted accused. The decision marks a significant development in one of the most closely followed criminal cases in the state.

The crime occurred in February 2017, when a prominent Malayalam film actress was abducted while travelling from Thrissur to Ernakulam after a film shoot. She was sexually assaulted inside a moving vehicle, and the act was allegedly recorded on a mobile phone. The occurrence of the crime itself was never disputed during the trial.

After a prolonged legal process, the Ernakulam District and Principal Sessions Court convicted six accused and sentenced them to 20 years of rigorous imprisonment. The court relied on testimonies, call records, and other circumstantial evidence to establish that these accused planned and executed the crime.

Actor Dileep, however, was acquitted as the court held that the charge of criminal conspiracy against him was not proved beyond reasonable doubt. The prosecution had alleged that he orchestrated the crime as an act of retaliation and intimidation, but the court concluded that the chain of circumstances linking him to the planning of the assault was incomplete and extended the benefit of doubt .

The case drew wider public attention as Dileep and the actress had acted together in six films , making them well-known professional associates in the Malayalam film industry. The trial court, however, made it clear that professional association alone could not establish criminal liability.

Following the acquittal verdict, the actress publicly expressed her disappointment , stating that the judgment had left her deeply distressed and that she felt complete justice had not been delivered. In a social media post, she said she was not seeking sympathy but fairness, and urged society to reflect on how survivors are treated within the justice system.

The state has now moved the High Court , arguing that the trial court inconsistently assessed the same body of evidence accepting it to convict the direct perpetrators while rejecting it in relation to the alleged conspiracy. The government is also seeking enhancement of the sentence awarded to the convicted accused, contending that it does not adequately reflect the gravity of the crime.

As the case enters the appellate stage, the High Court will re-examine the trial court’s reasoning and determine whether legal errors were committed. The outcome will be closely watched for what it signals about justice and accountability in cases involving serious crime, celebrity influence, and alleged abuse of power.
